摘要/Abstract

摘要： 契约与法律精神是深藏于人们思想观念中的对于契约与法律神圣性和约束力高度认可和尊崇的“思想习惯”或“精神态度”,德国民众契约与法律精神的形成经历了一个从对军事政治强权所确立的规则的忍耐服从到对基于民主平等原则所订立的契约和法律的尊重服从的演变过程。德国民众的契约与法律精神对双元职业教育立法过程和立法目标的实现均有着重大影响:该精神不仅决定着双元立法出现的可能性、制约着双元立法的创制过程、影响着双元立法的主要内容,而且还决定着双元立法实施的程度;此外,民众的契约与法律精神还从激励与约束的角度对双元立法目标的实现有着重要影响。

Abstract: The spirit of contract and law deeply hidden in peoples ideas is a kind of “habit of thought” or “spiritual attitude”,and its sacredness and binding force is highly recognized and respected.The formation of german peoles contract and legal spirit has experienced an evolutionary process from patience and obedience to the rules established by military and political power to respect and obedience to the contract and law on the principle of democratic eguality.The German peoples spirit of contract and law has a significant impact on the legislative process and goal of dual vocational education.Among them,the spirit not only determines the possibility of dual legislation,restricts the creation process of dual legislation,affects the main content of dual legislation,but also determines the degree of implementation of dual legislation.In addition,peoples contract and legal spirit also has an important impact on the realization of dual legislative goals from the perspective of incentives and constraints.
